The Tenant Left, the Furniture Didn’t: Tennessee’s Abandonment Rule for Shelby County Landlords

The rent is late, the porch light is off, and the mail is piling up. Is the unit abandoned, or is the tenant just away? Tennessee’s landlord-tenant act answers with two tests, a posted notice and a 30-day storage rule, and doing the steps out of order turns an empty unit into a lawsuit.

Where this law applies

Tennessee’s Uniform Residential Landlord and Tenant Act applies only in counties with more than 75,000 residents under the 2010 census. A commentary on the act lists 17 counties, and Shelby County is one of them. Fayette County, Tennessee is not on that list. This article addresses Shelby County, Tennessee; if your rental is in Fayette County, confirm with an attorney which rules govern before you act.

Two ways to show a tenant is gone

The abandonment rule sits in Tenn. Code Ann. § 66-28-405. Subsection (a) makes an unexplained or extended absence of 30 days or more, with rent unpaid when due, prima facie evidence of abandonment. Subsection (b) offers a faster route: rent unpaid 15 days past the due date, plus other reasonable facts showing the tenant has permanently left, such as removing substantially all possessions or voluntarily ending the utilities. Prima facie means a presumption, not a verdict. If the tenant shows up, the presumption can fall apart.

The notice that has to go out first

Under the faster route, the landlord posts a notice at the unit and also mails it, regular mail with postage prepaid, to the unit address. The notice must say the landlord believes the premises are abandoned, that the landlord will reenter unless the tenant makes contact within 10 days of posting and mailing, that the landlord will then remove remaining possessions and rerent the unit, and that anything not reclaimed within 30 days after the landlord takes it will be disposed of under the statute. It must include the landlord’s phone number and mailing address.

If the tenant does not respond within 10 days, the landlord may reenter and take possession. If the tenant does respond and says they intend to stay, the landlord must follow the act’s termination and judicial possession procedures instead; see our guide to the Shelby County eviction timeline for how long that takes.

Abandonment is a conclusion you document, not a hunch you act on.

What each week of waiting costs

Apartment List’s Memphis, TN rent report for November 2026 puts the citywide median at $1,063, down 0.4% from a year earlier. That is a Memphis city figure across unit types, not a Shelby County-wide or neighborhood rent, but it makes a usable yardstick. At $1,063 a month, an empty unit gives up about $35 of rent a day, or roughly $245 a week. Under the faster route, with rent 15 days late and the notice posted that day, the earliest reentry lands about 25 days in; waiting for the 30-day absence test pushes it to day 30 or later. Five days at that median is roughly $175 of rent. That is Homefront’s illustrative arithmetic, not a forecast, and unpaid rent already owed stays owed either way.

The belongings are the part owners get wrong

Whichever route you use, subsection (c) requires the landlord to remove the tenant’s possessions and store them for at least 30 days, during which the tenant may reclaim them. If nobody does, the landlord may sell or otherwise dispose of them and apply the proceeds to unpaid rent, damages, storage fees, the cost of the sale and attorney’s fees. Any balance left over must be held for six months after the sale. Before you move a single box, photograph every room with dated images and make a written inventory. Assume storage costs money: at an assumed $150 for one month, that is a real line item, so track it. For how the tenant’s deposit is handled afterward, see our post on security deposit rules in Shelby and Fayette counties.

Four ways owners get this wrong

The first is treating a long vacation as abandonment; the 15-day test needs more than unpaid rent. The second is skipping the mailed copy because the posted one “counts.” The third is changing the locks before the 10 days run out. The commentary notes that the same act treats a wrongful lockout as unlawful ouster under § 66-28-504, which can reverse the position of landlord and defendant overnight. The fourth is clearing the unit the same week and throwing everything away. A tenant with a dumpster-bound mattress and a lawyer is a bad outcome, and our post on Tennessee’s squatter removal law covers the opposite problem, an occupant who will not leave.

Why a vacant month hurts more this year

Freddie Mac’s Primary Mortgage Market Survey released October 29, 2026 put the 30-year fixed rate at 7.24%, down from 7.32% the week before. That is an owner-occupied benchmark; investor loans price above it. With Memphis rents flat, a vacant month is not made up by rent growth, which is the case for cutting every avoidable day from a turnover. Our breakdown of what a move-out costs shows how fast the days add up.

An abandonment checklist
